Got an AARTO notice: your options
A consequence map of the paths people commonly face after an infringement notice — so you know what DemeritCheck can model and what only RTIA / official forms can do.
Not legal advice. Deadlines, forms (for example AARTO 07 / 08), fees, and portal steps change and must be verified on your notice and official AARTO channels. This page describes categories of options for education only. We do not file documents or take payment.
First question: are you in the AARTO admin process?
Phase 2 AARTO administrative adjudication applies in municipalities listed in the relevant proclamations (from 1 July 2026 for the proclaimed set). Elsewhere, or for some older matters, you may still be in a Criminal Procedure Act / court-summons style process. If the paperwork does not look like an AARTO infringement notice, do not force it into this map — confirm with the issuing authority.
Decision tree (educational)
- Were you the driver? If not, owner/operator nomination processes may apply (commonly discussed under Form AARTO 07). That path is time-sensitive and form-driven. DemeritCheck cannot nominate anyone.
- Do you intend to settle the monetary penalty?Payment uses the notice’s official reference and authorised channels — not random bank details from social media. Paying the money side is not the same as clearing demerit points. Fine vs demerits →
- Do you intend to make representations?Representation processes (commonly Form AARTO 08) are about contesting the infringement through the Agency’s process. Unsuccessful outcomes and fees are set in official materials — verify current amounts; we do not republish stale fee tables as gospel.
- Instalments / later stagesCourtesy letters and enforcement orders change what options remain open and can affect licensing transactions when NaTIS blocks apply. Those stages are about the admin fine system; demerit licence recording still depends on sections 24–28 being proclaimed.
How this maps to the calculator
| Your situation (plain language) | Suggested calculator status | What DemeritCheck does |
|---|---|---|
| Notice received; process still open | Pending | Shows the code’s points but does not add them to the total |
| Matter concluded for your own modelling | Final | Adds Schedule 3 points toward the 15-point threshold |
| Unsure | Pending | Avoids overstating licence-risk maths |
When to get qualified help
Situations that usually sit outside a calculator’s job: criminal offences going to court, identity disputes, stacked notices near a future 15-point threshold, PrDP / employment risk, or enforcement-order blockages. Use official RTIA channels for filings; consult a qualified attorney for advice on your matter. We do not refer paid legal leads.
Demerit enforcement reminder
Even if the admin fine path is live in your municipality, demerit recording was not proclaimed as of August 2026. Model points here for education; verify licence consequences with official sources when the law changes.
